Terms of service
Effective 24 September 2026
These terms are the agreement between you and JRAM Productions, which operates Gather. Using Gather means accepting them. If you are accepting on behalf of an organization, you are confirming that you may bind it.
1. Accounts
Signing in to Gather uses an iUtils account. Keep its credentials to yourself, turn on two-factor authentication, and tell us at [email protected] if you think somebody else has got in. Anything done through your account is treated as done by you.
An account belongs to one person. Sharing one between a team defeats the audit log and makes a security question unanswerable.
2. Organizations
Work in Gather happens inside an organization. Its owner and admins control membership, settings, and what happens to the data it holds. Adding somebody to an organization gives them access to that organization's content according to their role, and removing them takes it away.
3. Your content and the people you invite
Sheets, event types, surveys and the responses they gather belong to your organization. We claim no ownership of them. We hold and process them to run the service for you, and for nothing else.
You decide what to ask people and who to contact, which makes you responsible for having a lawful reason to do it. That means asking only for what you need, honouring unsubscribe requests, and answering the people whose data you collected when they ask what you hold. Gather gives you export and erasure tools for that, and it enforces unsubscribes whether or not you remember to.
4. Acceptable use
Do not use Gather to:
- break the law, or help somebody else break it
- send unsolicited bulk email, or mail a list you did not collect yourself
- impersonate anybody, or build a page designed to collect credentials under false pretences
- probe, scrape or overload the service, or work around its rate limits and plan quotas
- resell Gather as your own product without a written agreement
- upload anything designed to damage a system or a person
5. Plans and payment
The free plan is free and stays free within its published limits. Paid plans are arranged directly with us, and their price, term and invoicing are whatever the two of us agreed in writing.
Going over a limit, or coming off a paid plan, never deletes or hides anything you made. Existing sheets, surveys, bookings and events keep working. You simply cannot create new ones until you are back within the limits.
6. Paid bookings
If you charge for bookings, you do it through your own Stripe account. The money goes from the invitee to you without passing through us, and Stripe's own terms govern that relationship. Pricing, refunds, chargebacks, tax and receipts are yours to handle. We are not a party to the transaction and cannot reverse one.
7. Services we depend on
Calendar sync, video links, payments, email and text messages run through Google, Microsoft, Zoom, Stripe, Twilio and a mail provider. Connecting one means accepting that provider's terms as well. When a provider changes or withdraws an interface, the matching feature in Gather can change or stop, and we will tell you when that affects you.
8. Availability
We aim to keep Gather up and to schedule maintenance when it will disturb the fewest people. There is no contractual uptime guarantee today. Saying otherwise would be a promise nobody is on call to keep, and a booking page that goes down for an hour is exactly the kind of thing you deserve honesty about in advance.
9. Suspension and ending the agreement
You can stop using Gather at any time. Export what you want to keep before you do.
We may suspend or close an account for a breach of these terms, for non-payment on a paid plan, or where continuing would put other customers at risk. Except where the law or an ongoing abuse requires otherwise, we will say why and give you a chance to put it right. After an account closes, its data is deleted on our normal schedule, and backups age out after that.
10. Our software
Gather, its code, design and name stay ours. These terms grant you the right to use the service, not to copy, decompile or rebrand it.
11. Warranties
Gather is provided as it is, without warranties of any kind beyond those the law will not let us exclude. We do not warrant that it will be uninterrupted, error free, or fit for a particular purpose you have in mind.
12. Liability
Neither side is liable to the other for indirect, incidental, special or consequential loss, or for lost profits, revenue or data, however it arises.
Our total liability arising out of or relating to these terms is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars if you are on the free plan. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.
13. Indemnity
You will cover us against claims arising from your use of Gather in breach of these terms, from the content you publish through it, or from the way you collected the data you put into it.
14. Changes to these terms
We may revise these terms. Material changes are announced to organization owners by email, and the effective date at the top of this page is updated. Continuing to use Gather after that means accepting the revision. If you do not accept it, stop using the service and tell us.
15. Governing law
These terms are governed by the laws of the State of Texas, United States, and the courts there have exclusive jurisdiction over any dispute, without regard to conflict of law rules.
